Planning for Loved Ones with Special Needs
As only those who have raised a child or cared for a loved one with special needs may know, such a circumstance can be filled with both great joy and great challenges. Careful planning should be undertaken to ensure that your loved one with special needs is provided for, should something happen to you.
Unfortunately, the rules governing this area of the law can be very confusing. For example, leaving a large sum of money directly to a disabled person may cause them to lose important benefits to which they would otherwise be entitled. Nevertheless, the law has provided a process by which you can leave money to a trustee who can then provide care for your loved one above and beyond that which can and is intended to be provided through public benefits.
